Sherrie Boutwell has specialized for twenty-five years in the areas of employee benefits law and ERISA, with an emphasis on retirement and deferred compensation plans. She has provided legal counsel to employers, employees, plan fiduciaries (including plan trustees and administrators), financial institutions, government agencies and trade associations on a broad range of employee benefits matters.
Ms. Boutwell has represented clients before the Internal Revenue Service, the Department of Labor, the Pension Benefit Guaranty Corporation, Arbitrators from the American Arbitration Association and the United States District Court, Central District of California with respect to the legal requirements applicable to qualified pension and profit sharing plans. She has experience working with the unique deferred compensation issues that arise in the non-profit and governmental employer arena. Sherrie also has many years of experience in the design and operation of non-qualified executive deferred compensation plans and the new requirements under Section 409A of the Code.
She was a regular contributing editor to and wrote numerous articles for “The 401(k) Advisor” (Panel Publishers) from 1994-2000 and is the author of the “Quick Reference to Plan Corrections: Correcting Pension Plans with EPCRS and VFCP, (Panel Publishers), 2000-2003.
Ms. Boutwell received her B.A. from the University of California, Irvine, magna cum laude, 1979. She obtained her J.D. in 1983 from the University of California, Los Angeles, where she was a member of the UCLA-Alaska Law Review. Ms. Boutwell is a member of the California Bar Association, the American Bar Association, the Western Pension & Benefits Conference, and serves on the board of the Orange County Chapter of the National Institute of Pension Administrators. She has lectured on retirement plan issues for the American Law Institute/American Bar Association, the Western Pension and Benefits Conference, the American Society of Pension Actuaries, the California League of Savings Institutions and the National Institute of Pension Administrators. She was formerly associated with the law firm of Morrison & Foerster.
